HKW successfully defended its client GBT, Inc., a subsidiary of Gigabyte Technology, in a patent infringement action brought in the U.S. District Court for the Central District of California

Led by Steve Hill and Martha Decker, HKW successfully defended its client GBT, Inc., a subsidiary of Gigabyte Technology, in a patent infringement action brought in the U.S. District Court for the Central District of California by Reversible Connections LLC accusing over 150 lines of Gigabyte computer products of patent infringement.  Following an inter partes review of the asserted patent, U.S. Patent No. 7,458,825, the Patent Trial and Appeal Board and Federal Circuit Court of Appeals held that all claims were unpatentable.  The patent holder separately sought an ex parte reexamination, resulting in the cancellation of all claims and new claims being added.

On January 26, 2022, the District Court rejected the plaintiff’s attempt to amend its complaint against GBT to assert infringement of one of the newly added claims by granting the motion to dismiss filed by HKW.  The District Court concluded that the newly asserted reexamined patent claim was nothing more than a “do-over” following cancellation of the original patent claims, such that the plaintiff was precluded from asserting the claims against GBT.  The District Court dismissed the case against GBT with prejudice.
